By accessing or using BistroCircle ("the Service"), you agree to be bound by this End User License Agreement ("EULA"). If you do not agree to these terms, please do not use the Service. This agreement is between you ("User") and BistroCircle ("Company").
Subject to the terms of this EULA and your subscription plan, BistroCircle grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. This license does not include the right to sublicense, resell, or redistribute the Service.
BistroCircle is a restaurant management platform that provides AI-powered order management, API integration services, analytics, and related tools for restaurant operators. Features available to you depend on your chosen subscription plan.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify BistroCircle immediately of any unauthorized use of your account. BistroCircle reserves the right to terminate accounts that violate these terms.
You may use the Service only for lawful purposes and in accordance with this EULA. You agree not to:
Access to the Service requires a paid subscription. Subscription fees are billed according to the plan you select. All fees are non-refundable except as required by law or expressly stated in these terms. BistroCircle reserves the right to change pricing with 30 days' notice. AI agent usage is billed on a pay-as-you-go basis in addition to your base subscription fee.
The Service and its original content, features, and functionality are and will remain the exclusive property of BistroCircle. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. You retain ownership of all data you upload or create through the Service.
BistroCircle may integrate with third-party APIs and services. You are responsible for ensuring that your use of third-party integrations complies with the applicable terms of service of those third parties. BistroCircle is not responsible for the availability, accuracy, or reliability of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BISTROCIRCLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BISTROCIRCLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE PRECEDING THREE MONTHS.
BistroCircle may terminate or suspend your access to the Service immediately, without prior notice, for conduct that violates this EULA or is harmful to other users, BistroCircle, or third parties. Upon termination, your right to use the Service ceases immediately. You may export your data for up to 30 days following account termination.
This EULA shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under this agreement shall be resolved in the courts located in California.
BistroCircle reserves the right to modify this EULA at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the new terms.
